Contract Litigation
Unlike business torts which involve intentional or reckless wrongful conduct, contract litigation focuses on whether the specific terms of an oral or written contract have been performed or breached. These cases require the legal understanding of contract law principles which govern the resolution of these cases. For example, some but not all business people may know that an ambiguous contract is usually construed against its drafter, or appreciate a prevailing party can recover attorney’s fees if a contract clause provides for their award.
